1. A method for protecting data rights, comprising:

acquiring basic information of data materials submitted by a data rights owner;

Technical Field

Background

In the digital era, data serving as key elements, production data and basic resources of digital economy is widely accepted by various industries, and governments and various industries all around strongly demand data sharing. With the more and more data mastered by each organization department, the more and more data range is required, and the exercise and the good data rights and interests protection become very urgent requirements of users on the basis of controllable risk and clear authority and liabilities.

At present, a data interest owner gives own data to a big data platform, the big data platform is published to the outside in a unified mode by a big data center, and the data is called and used for service, under the centralization condition, on one hand, a right party has no mechanism for guaranteeing the right and the scope of the right, and is easy to be over-authorized or infringed, on the other hand, the right party as a data interest main body cannot endorse data contents and uses the data as reliable source data.

Disclosure of Invention

The application aims to provide a data rights and interests protection method and system, and aims to solve the problems that no mechanism is provided in the prior art to ensure that rights and interests of data rights and beneficiaries are not infringed and data contents cannot be endorsed.

To solve the above technical problem, according to some embodiments, the present application provides a data rights protection method, including: acquiring basic information of data materials submitted by a data rights owner; generating a corresponding data material chaining request based on the acquired basic information of the data material, wherein the data material chaining request comprises data material field information and data material parameter information configured according to the acquired basic information of the data material to obtain data material configuration information; generating a corresponding data material chaining request according to the data material configuration information; and sending the generated data material chain entering request to a block chain bottom chain so that the block chain bottom chain performs consensus and verification on the data material chain entering request.

Preferably, the obtaining of the basic information of the data material submitted by the data rights holder includes at least one of: and acquiring a data material code, a data material name and a data grabber of the data.

Preferably, before configuring the data material field information and the data material parameter information according to the basic information of the acquired data material, the method further includes: checking the acquired basic information of the data material; and when the basic information of the data material is checked to be correct, configuring data material field information and data material parameter information to obtain data material configuration information.

Preferably, the checking the acquired basic information of the data material specifically includes: checking whether the obtained basic information of the data material obtains a data material code, a data material name and a data grabber of the data; and if so, configuring data material field information and data material parameter information.

Embodiments of the present disclosure have at least the following advantages: the data interest owner completes uplink operation on the data material configuration information of the own data, and the uplink operation is 'autonomous and controllable data interest management without third party intervention', and the data interest owner can autonomously complete management on the own data, autonomously complete autonomous definition on basic information and details of the data material, and further protect the data right of the data interest owner.

Detailed Description

At present, in a centralized situation, on one hand, there is no mechanism to guarantee which rights and scope restrictions of rights are owned, and it is easy for an unauthorized or infringement to occur, and on the other hand, a rights party as a data rights principal cannot endorse data contents and uses it as data of a reliable source.

To solve the above problem, an embodiment of the present application provides a method for protecting a data right, including: acquiring basic information of data materials submitted by a data rights owner; generating a corresponding data material chaining request based on the acquired basic information of the data material; and sending the generated data material chain entering request to a block chain bottom chain so that the block chain bottom chain performs consensus and verification on the data material chain entering request.

To make the objects, technical solutions and advantages of the embodiments of the present application clearer, the embodiments of the present application will be described in detail below with reference to the accompanying drawings. However, it will be appreciated by those of ordinary skill in the art that in the examples of the present application, numerous technical details are set forth in order to provide a better understanding of the present application. However, the technical solution claimed in the present application can be implemented without these technical details and various changes and modifications based on the following embodiments. The detailed description may include that the blockchain is a novel application mode of computer technologies including distributed data storage, point-to-point transmission, consensus mechanism, encryption algorithm, etc. of a set of blocks, and the blockchain is essentially a shared database, and data related information is stored in the blocks of the blockchain. In practical applications, data is processed and mined to be converted into a data product which has huge commercial value and thus property rights and interests, so that the data rights and interests need to be managed.

In one example, the data interest owner issues basic information of data material of own data to the data interest consensus management terminal, wherein the basic information of the data material comprises a data material code, a data material name and a data grabber of the data. The data rights owner may select the type of publication, such as data retrieval, data verification, data calculation, data query, data sinking, etc., when publishing its own data rights.

And the data interest consensus management end identifies according to the basic information of the data material issued by the data interest owner, and configures the data material field information and the data material parameter information according to the basic information of the acquired data material to obtain the data material configuration information after the data interest consensus management end acquires the basic information of the data material and meets the requirement. In this step, each federation member can issue basic information of data material belonging to own data to the data interest consensus management terminal.

And step S102, checking the acquired basic information of the data material.

The consensus deposit evidence is a necessary step for realizing decentralization, the result of transaction or audit represented by the consensus is jointly made by the coalition members, all the coalition members are jointly responsible for endorsement of the result of the transaction or audit, the deposit evidence is a technical means for recording the result of the consensus of the coalition members, the technical means needs to ensure that the sources of the transaction and consensus result are legal and effective, the result cannot be tampered after being stored, and the consensus deposit evidence is a technical basis for ensuring the audit result to be real and effective.

And S105, storing the digital signature generated by the data material configuration information into a consensus ledger of the block chain network.

Specifically, all the alliance members collectively perform consensus on the data material link entering request under the blockchain, when the transaction results of member nodes within a certain range are consistent, namely the consensus passes, the transaction results are considered to be valid, and the digital signature generated by the data material configuration information is stored in the consensus ledger of the blockchain network through a hash algorithm. The coalition members are jointly responsible for endorsement of the transaction or audit result, the consensus certificate can ensure that the source of the transaction and consensus result is effective, the result cannot be tampered after being stored, meanwhile, the provided data authentication is completed through a block chain consensus mechanism, and the traceability of the block chain is used for ensuring the rights and interests of the coalition members in the data use process: ownership, usage right, transmission right and the like are not infringed, and the right is not lost, infringed and unauthorized.

In other embodiments, when the federation members reach a consensus, an in-chain notification of new data material is also broadcast in the blockchain network, so that the data interest user can query the data material of the new in-chain from the chain after receiving the in-chain notification of the data material, and call the data material to the service scenario.

The specific query operation comprises that when a data rights and interests user initiates data use scene maintenance, the scene needs to call which data materials, query and search can be carried out, and then related data materials are selected, namely scene data material association is initiated.

Through the steps of S101-S105, the data interest owner completes the uplink operation on the data material configuration information of the own data, and the uplink operation is the "autonomous and controllable data interest management without third party intervention", and the data interest owner can autonomously complete the management on the own data, autonomously complete the autonomous definition on the basic information and details of the data material, further protect the data rights of the data interest owner, and manage the own data by the data interest owner, determine the use range of the data, and can also realize the effective control on the data interests without a centralized management platform. Data authorization is completed through a block chain intelligent contract, diffusion and recovery of owned data by a data interest owner and the data interest use range and limitation of a data interest user can be guaranteed, namely, the data can be used for which service scenes; on the other hand, when one-to-one data equity or responsibility disputes occur, the consensus result information of the coalition members in the block link environment can be used as a legal basis for clearing disputes, and whether the unauthorized behavior is a data owner or a data user is determined, so that the equity data can be transmitted and found legally and orderly, the data equity exercise process can be carried out orderly, and the data equity disputes can be effectively prevented.

Fig. 2 illustrates a schematic block diagram of a data rights protection system in accordance with an embodiment of the disclosure. As shown in fig. 2, the system includes:

the data rights and interests consensus management terminal 1 is used for acquiring data material configuration information, generating a data material link entering request and sending a block link bottom link 2; configuring data material field information and data material parameter information according to the acquired basic information of the data material to obtain data material configuration information; and generating a corresponding data material chaining request according to the data material configuration information.

And the block chain bottom chain 2 is used for verifying the data material in-chain request, identifying the data material in-chain request together, and performing uplink processing on the new data material configuration information request passing the verification.

The block chain bottom chain 2 includes: a data catalog management intelligent contract unit 21, configured to perform management check on data materials requested to be linked; and the supervision intelligent contract unit 22 is used for performing management check on whether the data directory management intelligent contract unit 21 operates normally.

The data rights and interests consensus management terminal provided by the embodiment of the disclosure acquires data material configuration information issued by a data rights and interests owner, checks the information, generates a data material link entering request after meeting requirements, and sends the data material link entering request to a block link bottom link. The data rights and interests of the alliance members are guaranteed through the block chain, and the data rights and interests are exercised under the authentication of a consensus mechanism, so that the rights are not lost, infringed and unauthorized.
