1. A method for evaluating a patent with high asset value is characterized by comprising the following steps:

receiving an asset value evaluation request aiming at a patent to be evaluated, which is triggered by a user;

establishing a group contact object corresponding to the patent to be evaluated in an instant messaging tool, performing element analysis on the patent to be evaluated based on a preset element analysis model, acquiring element components contained in the patent to be evaluated, adding the element components serving as contact objects into a group of the group contact object to form group members, and setting a related contact corresponding to each group member;

sending the component content of the element component corresponding to each group member to the associated contact person for asset value evaluation based on the component;

and judging whether the patent to be evaluated is a high-asset-value patent or not according to the asset value evaluation result of all the element components contained in the patent to be evaluated.

The method of claim 1, wherein: a patent information acquisition column is arranged in a user interface of the instant messaging tool to acquire patent information to be evaluated input by a user, wherein the patent information to be evaluated comprises patent application number, patent publication number and/or invention name information.

The method of claim 1, wherein: the element components comprise technical element components and non-technical element components, the related contact persons of the technical element components are the evaluators corresponding to the fields and/or types to which the technical element components belong, and the related contact persons of the non-technical element components are the evaluators corresponding to the fields and/or types to which the non-technical element components belong;

setting the initial values of the technical asset value Q and the non-technical asset value P of the patent to be evaluated as 0;

acquiring technical element components and non-technical element component information corresponding to a patent to be evaluated;

for each technical element component i, acquiring a property score Si evaluated by the associated contact person, judging whether the property score Si of the technical element component exceeds a preset first property threshold value, executing Q + +, and otherwise keeping the current Q value unchanged, wherein the property score Si of the technical element component exceeds the preset first property threshold value; and for each non-technical element component j, acquiring a property score T [ j ] evaluated by the associated contact person, judging whether the property score T [ j ] of the non-technical element component exceeds a preset second property threshold value, executing P + +, if so, keeping the current P value unchanged;

the user client is used for receiving an asset value evaluation request aiming at a patent to be evaluated, which is triggered by a user, and outputting an evaluation result of the patent to be evaluated;

the system server is used for establishing a group contact object corresponding to the patent to be evaluated in the instant messaging tool, performing element analysis on the patent to be evaluated based on a preset element analysis model, acquiring element components contained in the patent to be evaluated, adding the element components serving as contact objects into a group of the group contact object to form group members, and setting a related contact corresponding to each group member; and the number of the first and second groups,

Technical Field

The invention relates to the technical field of value prediction of intangible assets, in particular to a method, a device and a system for evaluating a high-asset-value patent.

Background

Value or value is a generally accepted attribute of an asset, and thus whether it is in physical form (or physical form), and assets can be classified as tangible and intangible. Among them, patents are an important type of intangible assets. A patent is an intangible asset, and the value of a patent asset refers to the performance (generally expressed as an economic benefit) of the benefit that the patent is expected to bring to its owner or user under realistic market conditions. Patents that bring benefits beyond industry average standards may be referred to as high asset value patents.

The determination of the amount of value of a patent asset is typically dependent on a patent value assessment. In the current patent value evaluation process, after a patent to be evaluated is consulted by a patentee or a stakeholder to a professional intellectual property office, the patent value is evaluated by a patent value evaluator, so that the value of the patent is obtained. The patent value evaluation method comprises a cost method, a market price method and a profit method, wherein the market price method is taken as an example, and the method is a method for determining the value of an evaluated asset by comparing the similarity and the dissimilarity of the evaluated asset and comparable similar assets and adjusting the market price of the similar assets. On the other hand, there are also prior arts attempting to evaluate the value of the invented patent using different classical financial models, from a simple financial calculation method based on the monetary time value, to a very complicated complex model (patent value evaluation model) integrating quantitative analysis and qualitative analysis. By way of example, a patent currency value assessment model developed by Hua for the company, Union Oxford university, uses 4 primary indexes, 16 secondary indexes, and 10 tertiary indexes, and introduces variables in dimensions of patent technology, business data, market, and macro economy. The patent value is evaluated by integrating information of multiple dimensions such as technology, law, economy and the like, and the method is also a mode commonly adopted by various Chinese and foreign value evaluation organizations.

No matter which patent value evaluation method is adopted, a patentee or a stakeholder as a client needs to perform information interaction such as consultation, information transmission and the like with a service party providing patent value evaluation service. However, the existing information interaction process and the existing evaluation process have the defects that the time consumption is long, and the client side cannot obtain feedback in time. Usually, for example, a client wants to communicate with an evaluator about specific information of a certain index item of a patent, the communication is usually based on communication tools such as mails, telephones, qq or WeChat, and the communication efficiency is low, and the docking process is tedious and time-efficient.

In summary, how to provide an evaluation method of a patent with high asset value, which is simple in operation, efficient in communication, and convenient in docking, is a technical problem that needs to be solved urgently at present.

Disclosure of Invention

The invention aims to provide a method, a device and a system for evaluating a high-asset value patent, which can establish a group contact object corresponding to a patent to be evaluated in an instant messaging tool, add element components contained in the patent to be evaluated into a group of the group contact object as contact objects to form group members, and set associated contacts corresponding to each group member so as to evaluate the value of each element component through a special associated contact, so that a user can conveniently obtain element component information and communicate with the associated contact corresponding to the element component as required. The evaluation method is simple to operate, facilitates personnel communication and butt joint, and can remarkably improve the value evaluation efficiency of patent assets.

In order to achieve the above object, the present invention provides the following technical solutions:

a method for evaluating a high-asset-value patent comprises the following steps:

receiving an asset value evaluation request aiming at a patent to be evaluated, which is triggered by a user;

establishing a group contact object corresponding to the patent to be evaluated in an instant messaging tool, performing element analysis on the patent to be evaluated based on a preset element analysis model, acquiring element components contained in the patent to be evaluated, adding the element components serving as contact objects into a group of the group contact object to form group members, and setting a related contact corresponding to each group member;

sending the component content of the element component corresponding to each group member to the associated contact person for asset value evaluation based on the component;

and judging whether the patent to be evaluated is a high-asset-value patent or not according to the asset value evaluation result of all the element components contained in the patent to be evaluated.

Furthermore, a patent information acquisition column is arranged in a user interface of the instant messaging tool to acquire patent information to be evaluated input by a user, wherein the patent information to be evaluated comprises patent application number, patent publication number and/or invention name information.

Further, the element components comprise technical element components and non-technical element components, the related contact persons of the technical element components are the evaluators corresponding to the fields and/or types to which the technical element components belong, and the related contact persons of the non-technical element components are the evaluators corresponding to the fields and/or types to which the non-technical element components belong;

Further, the step of determining whether the patent to be evaluated is a high-asset-value patent comprises,

setting the initial values of the technical asset value Q and the non-technical asset value P of the patent to be evaluated as 0;

acquiring technical element components and non-technical element component information corresponding to a patent to be evaluated;

for each technical element component i, acquiring a property score Si evaluated by the associated contact person, judging whether the property score Si of the technical element component exceeds a preset first property threshold value, executing Q + +, and otherwise keeping the current Q value unchanged, wherein the property score Si of the technical element component exceeds the preset first property threshold value; and for each non-technical element component j, acquiring a property score T [ j ] evaluated by the associated contact person, judging whether the property score T [ j ] of the non-technical element component exceeds a preset second property threshold value, executing P + +, if so, keeping the current P value unchanged;

and acquiring information sent by a user in the element interactive interface, performing semantic analysis on the information, and sending the information to the associated contact person when judging that the information is related to the patent asset value evaluation.

Further, the element interaction interface comprises an element component name field, a sending information output field, a sending information input field and an associated information field, wherein the sending information input field is used for collecting information input by a user, the sending information output field is used for outputting information records sent by the user, and the associated information field is used for outputting associated contact information.

And further, outputting a contact person head portrait icon of the associated contact person in the associated information bar, acquiring the triggering operation of the user on the contact person head portrait icon, and outputting an instant messaging interactive interface between the user and the corresponding associated contact person.

The invention also provides an evaluation device of the high-asset-value patent, which comprises the following structure:

The invention also provides an evaluation system of the high-asset-value patent, which comprises a user client and a system server;

and sending the component content of the element component corresponding to each group member to the associated contact person to perform asset value evaluation based on the component, and judging whether the patent to be evaluated is a high asset value patent according to the asset value evaluation result of all the element components contained in the patent to be evaluated.

Due to the adoption of the technical scheme, compared with the prior art, the invention has the following advantages and positive effects as examples: the method can establish a group contact object corresponding to the patent to be evaluated in the instant messaging tool, add element components contained in the patent to be evaluated into a group of the group contact object as contact objects to form group members, and set associated contacts corresponding to each group member so as to evaluate the value of each element component through a special associated contact at a later stage, so that a user can conveniently obtain element component information and communicate with the associated contacts corresponding to the element components as required. The evaluation method is simple to operate, facilitates personnel communication and butt joint, and can remarkably improve the value evaluation efficiency of patent assets.

The method, device and system for evaluating high-asset-value patents disclosed by the invention are further described in detail with reference to the accompanying drawings and specific embodiments. It should be noted that technical features or combinations of technical features described in the following embodiments should not be considered as being isolated, and they may be combined with each other to achieve better technical effects. In the drawings of the embodiments described below, the same reference numerals appearing in the respective drawings denote the same features or components, and may be applied to different embodiments. Thus, once an item is defined in one drawing, it need not be further discussed in subsequent drawings.

In the present invention, the component of the element contained in the patent refers to the essential factors that can affect the value of the patent assets and are summarized from various information related to the patent. By way of example and not limitation, the composition may specifically include three broad categories of technical element components, legal element components and economic element components.

The technical element components refer to technical factors capable of influencing the value of the patent assets and can comprise two subclasses. The first subclass is the technical factors that can be directly derived from the claims and can represent the technical field of the patent and its technical scope (including: type, means, object, material, part, etc.). In this case, the technical component may be a complete technical solution of a patent, may be a technical means composed of a plurality of technical features, or may be one technical feature. The second subclass is the technical factors that need to be determined in conjunction with other information, and typically includes alternatives, advancement, innovativeness, maturity, practicality, defensiveness, monopoly, and the like.

The legal element components refer to legal factors that can affect the value of a patent asset, and generally include right attributes and right limits of the patent asset, patent category, legal state of the patent, protection period of the remaining issue of the patent, protection scope of the patent, review information, invalidation information, litigation information, and the like.

The economic element component refers to economic factors that can affect the value of a patent asset, and generally includes acquisition cost, profitability, license fee, transaction price of similar assets, and the like of the patent asset. The economic element components can also comprise factors which can reflect the application range, market demand, market prospect and market life of the patent products, the development condition of related industry policies, macro economy, the competition condition of similar products and the profitability of the patent products.

Examples

Referring to fig. 1, a method for evaluating a high-asset-value patent provided by an embodiment of the present invention includes the following steps:

s100, receiving an asset value evaluation request aiming at a patent to be evaluated, which is triggered by a user.

The user may trigger the asset value assessment request through an instant messaging tool on the user terminal, and may determine information of the patent to be assessed before or after issuing the asset value assessment request. The user terminal can be a desktop computer, a notebook computer, a mobile phone or wearable intelligent terminal equipment such as an intelligent watch, an intelligent bracelet and the like. And the user terminal is provided with an instant messaging tool.

Preferably, a patent information collecting column is arranged in the user interface of the instant messaging tool to collect the patent information to be evaluated input by the user. As an example of a typical manner, for example, after a user inputs the patent application number, the patent publication number, and/or the invention name information of a patent to be evaluated in the patent information collection column, the asset value evaluation request may be triggered.

The operation manner in which the user triggers the asset value assessment request may be, by way of example and not limitation, an enter operation performed by the user after inputting patent information to be assessed. Optionally, an evaluation request sending control is arranged corresponding to the patent information collecting column, and when the operation information that the user selects the evaluation request sending control is collected, it is determined that the user triggers the asset value evaluation request. In the prior art, a user logs in an instant messaging tool to establish a connection between an instant messaging client and an instant messaging server. The instant communication tool outputs a user main interface to a user through a display screen of the user terminal. Referring to fig. 2, the user main interface may display a user avatar 110, a search bar 120, a contact list 130 pushed by the instant messaging server, group (or group, group chat) list information, and the like. The contact list 130 records the avatar, nickname, signature, presence, session message, and friend information such as ranking of the contact object 131. The names of the members of each group may represent the domain, type and/or key content of the constituent components, in which case the names are preferably keywords in the constituent components, or may be indicated by numbers only, such as constituent component 1, constituent component 2, constituent component 3, and the like.

And finally, inquiring a preset corresponding relation table of the fields and/or industries and the evaluators by analyzing the fields and/or types of the element components in the patent evaluation group, and acquiring the corresponding evaluators as the associated contacts of the element components. The correspondence table of the field and/or industry and the evaluator may be preset by a user or a system.

Specifically, the element component may include a technical element component and a non-technical element component, the related contact of the technical element component is an evaluator set in the field and/or type to which the technical element component belongs, and the related contact of the non-technical element component is an evaluator set in the field and/or type to which the non-technical element component belongs. Preferably, when the group member list is displayed, the group members corresponding to the technical element component and the non-technical element component are displayed separately. The non-technical element components may specifically include legal element components and economic element components.

Taking the IM tool Wechat as an example, for example, Austus inputs the application number information "20161072 × 8" of the patent to be evaluated in the patent information collection field 140 and issues a request for evaluation of the asset value. The instant messaging client sends the collected patent information and the evaluation request to the server, and the server establishes a group contact object corresponding to the patent to be evaluated in the instant messaging tool to serve as a patent evaluation group.

The patent evaluation group can be displayed in the group list as other conventional chat groups, for example, as shown in fig. 4, a conventional group contact object 151 and a patent group contact object 152 are displayed in the group list 150, the conventional group contact object 151 corresponds to a conventional chat group in the prior art, the patent group contact object 152 corresponds to a patent evaluation group, and unlike the conventional chat group, the group members in the patent evaluation group correspond to the element component information related to the value evaluation included in the patent, and the group members in the conventional chat group are chat objects of the user.

Meanwhile, the instant messaging server obtains the patent associated information corresponding to the application number by searching the associated patent database (which can be a local patent information database, a network patent information database and/or a patent information database of other permitted terminals), it may include the patent document full text of the patent under evaluation, technical-related information (including information such as substitution, advancement, novelty, maturity, utility, defensiveness, and monopolity of the patent asset), legal-related information (including information such as right attributes and right restrictions of the patent asset, patent category, legal status of the patent, protection period of the remaining issue of the patent, protection scope of the patent, review information, invalidation information, and litigation information), economic-related information (including information such as acquisition cost, profitability, license fee, transaction price of similar assets, etc. of the patent asset). The patent association information in the associated patent database may be pre-stored, and the patent database may be a database established by the instant messaging tool itself, or may be related data services purchased by the instant messaging tool, which is not limited herein.

And then, the instant messaging server performs element analysis on the patent associated information of the patent to be evaluated based on a preset element analysis model to obtain element components contained in the patent to be evaluated, and the element components are used as contact objects to be added into the group of the group contact objects to form group members.

As a typical example, the element analysis model adopts a three-element model, the three elements include technical elements, legal elements and economic elements, the element analysis model can divide the patent related information into three major categories of technical element components, legal element components and economic element components, each major category of element components can further include one or more minor element components, and each element component included in the patent to be evaluated is added as a contact object into a group of the group contact objects to form a group member. It should be noted that, depending on the completeness of the patent association information of different patents to be evaluated, a patent to be evaluated does not necessarily include all three major categories of elements, for example, a certain patent to be evaluated may only include a technical element component (which may include one or more minor category element components) and a legal element component (which may include one or more minor category element components) because it does not have economic association information.

For example, but not by way of limitation, the instant messaging server performs element analysis on the patent association information of the patent to be evaluated based on the three-element analysis model to obtain 4 element components included in the patent to be evaluated, and then adds the 4 element components as contact objects into the group of the group contact objects to form group members. The 4 element components comprise 3 technical element components and 1 non-technical element component, 3 associated contacts of the 3 technical element components are evaluators in the field of gait recognition system specialties, the field of human motion profile processing specialties and the field of convolutional neural network model specialties respectively, and the associated contacts of the non-technical element components are evaluators in the field of gait recognition cameras (patent products corresponding to the patent).

Preferably, when the group member list is displayed, the group members corresponding to the technical element component and the non-technical element component are displayed separately. By way of example and not limitation, for example, a distinguishing identifier is arranged at the upper end of the head portrait of the group member corresponding to the non-technical element component — a cloud identifier is illustrated in fig. 4, so that the user can conveniently identify the technical element component and the non-technical element component in the contact list. Of course, other character or graphic indicators may be used as desired, and are not intended to limit the present invention.

According to the technical scheme provided by the invention, the functions of the existing contact application are improved, and a group contact object corresponding to a patent to be evaluated can be established based on the contact application to serve as a patent evaluation group for a user to acquire, communicate, maintain or manage evaluation related information (embodied by element components) of the patent. The patent group contact object in the invention corresponds to a patent evaluation group, which is different from a conventional chat group, wherein the group members in the patent evaluation group correspond to element component information contained in the patent and related to value evaluation, the group members in the conventional chat group are chat objects of users, the group members in the patent evaluation group are triggered, element interaction interfaces corresponding to the element components are output, the group members in the conventional chat group are triggered, and the instant communication interaction interfaces of the users and the group members are output.

In this embodiment, when the triggering operation of the group member by the user is acquired, the element interaction interface of the element component corresponding to the group member is output, and the name of the element component, the component content of the element component, and the associated contact information are output in the element interaction interface. At this time, the information sent by the user in the element interactive interface can be acquired, semantic analysis is performed on the information, and when the information is judged to be related to the patent asset value evaluation, the information is sent to the related contact.

Specifically, referring to fig. 6, the element interaction interface 300 may include an element component name field 310, a sending information output field 320, a sending information input field 330, and an associated information field 340, where the sending information input field 330 is used to collect information input by a user, the sending information output field 320 is used to output an information record sent by the user, and the associated information field 340 is used to output associated contact information.

Specifically, a contact photo icon of the associated contact is output in the associated information bar 340, a trigger operation of the user on the contact photo icon is collected, and an instant messaging interaction interface between the user and the corresponding associated contact is output.

In another implementation manner of this embodiment, an asset value evaluation result of the associated contact may also be obtained, and the asset value evaluation result may be sent to the group as a group message, where a group member corresponding to the associated contact is used as a sender of the group message, as shown in fig. 7, so that the user may obtain an asset value evaluation result of each associated contact for the corresponding element component through the patent evaluation group.

Referring to fig. 8, another embodiment of the present invention further provides an evaluation apparatus for high-asset-value patents.

The apparatus 500 includes a structural information collection module 510, an initialization module 520, and a value evaluation module 530 as follows.

The information acquisition module 510 is configured to receive an asset value assessment request for a patent to be assessed, where the asset value assessment request is triggered by a user.

The initialization module 520 is configured to establish a group contact object corresponding to the patent to be evaluated in the instant messaging tool, perform element analysis on the patent to be evaluated based on a preset element analysis model, obtain element components included in the patent to be evaluated, add the element components as contact objects into a group of the group contact object to form group members, and set a relevant contact corresponding to each group member.

The value evaluation module 530 is configured to send the component content of the element component corresponding to each group member to the associated contact person for component-based asset value evaluation; and judging whether the patent to be evaluated is a high-asset-value patent or not according to the asset-value evaluation result of all the element components contained in the patent to be evaluated.

Other technical features refer to the foregoing embodiments, and each module may be configured to perform corresponding information acquisition, information transmission, and information processing processes, which are not described herein again.

According to another embodiment of the invention, the evaluation system of the high-asset-value patent is further provided.

The system comprises a user client and a system server.

The user client is used for receiving an asset value evaluation request aiming at the patent to be evaluated, which is triggered by a user, and outputting an evaluation result of the patent to be evaluated.

The system server is used for establishing a group contact object corresponding to the patent to be evaluated in the instant messaging tool, performing element analysis on the patent to be evaluated based on a preset element analysis model, acquiring element components contained in the patent to be evaluated, adding the element components serving as contact objects into a group of the group contact object to form group members, and setting a related contact corresponding to each group member; and sending the component content of the element component corresponding to each group member to the associated contact person to perform component-based asset value assessment, and judging whether the patent to be assessed is a high-asset-value patent or not according to the asset value assessment results of all the element components contained in the patent to be assessed.

Other technical features refer to the foregoing embodiments, and each component may be configured to perform corresponding information acquisition, information transmission, and information processing processes, which are not described herein again.

It should be noted that the evaluator taking the associated contact as the element component in the present invention is a professional evaluator belonging to the element component, and is responsible for evaluating the element component assigned to the evaluator and communicating the asset evaluation related information of the element component with the user, for example, but not limited to, solving the user's question, adjusting the evaluation parameter according to the user's requirement, or asking the user to provide the asset value evaluation information related to the element component according to the evaluation requirement. The specific way of the associated contact person to perform asset value assessment on the element components may be based on manual assessment, or may be based on automatic assessment by a full-automatic value assessment system (an evaluator only needs to input element component information into a corresponding value assessment system as required), or may be based on manual assistance to perform assessment in combination with a semi-automatic value assessment system (an evaluator needs to input element component information and collect other relevant information required for assessment), which is not limited by the present invention.
